Welcome to ByteMall and services (hereinafter referred to as "ByteMall and Services") provided by BYTEDANCE PTE. LTD(hereinafter referred to as "we", "our", "us" or the "Company"). ByteMall and Services provide you an e-commerce platform within the company.

 

This Privacy Policy sets out how we process, collect, use and disclose your Personal Information when you use ByteMall and Services. This Privacy Policy constitutes a legally binding agreement between you and us. We hereby remind you to carefully read and fully understand each section of this Privacy Policy, especially the sections regarding exclusion and limitation of our liability, restriction of your rights, dispute resolution and governing laws.

 

We will collect and use your Personal Information in accordance with applicable laws and regulations, and will implement security measures to protect your Personal Information and privacy. We hope to introduce the practices and principles regarding how we process your Personal Information to you through this Privacy Policy. Please read carefully and have a thorough understanding of this Privacy Policy before you use ByteMall and Services, and decide whether to accept this Privacy Policy after careful consideration. If you do not agree to this Privacy Policy, please immediately stop your use of ByteMall and Services.

 

Terms that are not defined in this Privacy Policy shall have the same meaning given to them under [ByteMall Terms of Service].

1.How we collect your Personal Information

 

1.1 During your use of ByteMall and Services, we will collect your Personal Information such as your name, contact information and address directly from you, country where you are employed and other information (such as order information and payment information) generated during your use of ByteMall and Services by automated means, in accordance with the principles of reasonableness, lawfulness, legitimacy and necessity.

 

1.2 In order to ensure the normal operation of the basic functions of ByteMall and Services, you should make sure that your Personal Information provided by you is true, accurate and valid. You should update the relevant Personal Information in a timely manner if there are any changes. If you are unable to use ByteMall and Services due to your failure to update your Personal Information in a timely manner, you will take full responsibility. Particularly, you are responsible for the losses suffered by employers, Affiliates, service providers or other third parties arising from the inaccurate or incomplete Personal Information you provided.

 

1.3 Information we collect during your use of ByteMall and Services:

 

1.3.1 Device information and network information. Your device model and settings, operating system information and version, and IP address.

 

1.3.2 Log Information. Information related to your use of certain functions of ByteMall and Services, including the time and duration of your use of ByteMall and Services, network request information, standard system logs, behavior log information arising from your use of or actions on ByteMall and Services, and event information of your device and software.

 

1.3.3 Cookies and Similar Technologies. We use cookies and other similar technologies (such as web beacons and Flash cookies) (the "Cookies") to enhance your experience of using ByteMall and Services. When you use ByteMall and Services, we may use the relevant technologies to send one or more Cookies or anonymous identifiers to your device to collect and store your information generated when you access and use ByteMall and Services. Most web browsers automatically accept Cookies, while allowing you to decide whether to accept Cookies on a case-by-case basis. You may choose to accept or disable Cookies. You understand and agree that we may place Cookies that are strictly necessary for the operation of ByteMall and Services, including Cookies that enable you to access secure areas of ByteMall and Services, and that the Cookies we place will expire upon termination of your system session or after 14 days. The aforesaid strictly necessary Cookies is a necessary condition for us to provide you with the core services of ByteMall and Services. If you do not give us your permission to implement the strictly necessary Cookies, you will not be able to use any functions of ByteMall and Services.

 

In particular, please note that if the information cannot, by itself or in combination with other information, be used to identify your personal identity, such information will not be considered as your Personal Information (e.g., the standalone device information and service log information). When your information can, by itself or in combination with other information, be used to identify your personal identity, such information will be processed and protected as your Personal Information in accordance with this Privacy Policy during the use of such combined information.

 

1.4 Information from our Affiliates and third parties

 

We may obtain information about you from our Affiliates and third parties, and may combine such information with other information that we receive or relates to you. For example, we may obtain your profile picture, email information, and phone number information through your third-party account when you use such third-party account to log in to ByteMall and Services.

 

2.How we use your Personal Information

 

2.1 We will use your Personal Information for the following purposes:

 

2.1.1 To display account information

 

When you log in to ByteMall using your third-party account, we may collect your account information such as user name and profile picture information for the purpose of displaying such information on ByteMall and Services and/or your order page.

 

2.1.2 To display product information and search

 

In order for you to quickly find the product you are looking for, we may collect your device information and browser type to display product information in the best way to you. We may also use your Personal Information in order to continually improve and optimize the aforementioned functions.

 

You can also use the search function to find the specific product you are looking for. We will retain your search records to facilitate your repetitive search input or to show you the products related to your search. Please note that your search keywords information, when used alone, cannot be used to identify your identity and does not constitute your Personal Information, and we have the right to use such information for any purpose. Only when your search keywords information is used in combination with your other information and such combined information can be used to identify your identity, we will treat your search keywords information as your Personal Information, and will process and protect such information, together with your search history, in accordance with this Privacy Policy during the use of such combined information.

 

2.1.3 To provide "Add to Favorite" and "Add to Cart" function.

 

When you browse through ByteMall and Services, you may choose to add items you are interested in to your "Favorite" list or your "Cart". When you are using the abovementioned functions, we will collect service log information including your "Favorite" and "Cart" history for providing the abovementioned functions and for other purposes expressly notified by us.

 

2.1.4 To place and manage orders

 

When you order specific products and/or services through ByteMall and Services, an order of the purchased products will be generated for you through the ByteMall and Services system. When you place the order, you should at least provide the recipient's name, delivery address and contact information, and the order will specify the order number, information about the product purchased by you, the amount payable for the product and the payment method chosen. We collect and use such order information to complete your transaction smoothly and to ensure the security of the transaction (e.g., to determine whether your transaction is abnormal by your order information), to manage your order, to provide after-sales services, and for other purposes expressly notified by us.

 

You can purchase products for others using ByteMall and Services and you need to provide the aforementioned Personal Information of the actual recipient of the product. You are responsible for obtaining the consent of the individual whom you are purchasing the product for. When you provide the Personal Information of other individuals, you warrant that you have notified the individuals of the purposes of processing the Personal Information and have obtained consent from the individual(s). If there is any Personal Information belonging to a child, you should ensure that you have obtained consent from the child's parent or legal guardian before providing us with the child's Personal Information, and you are solely responsible for all liabilities arising therefrom.

 

In order to facilitate the process of searching and managing your order information, we will collect the order information generated during your use of ByteMall and Services and display such order information to you for the purposes of managing your orders.

 

2.1.5 Payment

 

After you place an order, you can choose the payment service provided by third party payment institutions supported by ByteMall and Services. The payment function itself does not collect your Personal Information, but we need to share your order number and transaction amount information with the third party payment institution so that they can confirm your payment instruction and complete the payment process.

 

2.1.6 Order delivery

 

After you place an order and complete the payment online, the Company, the Company's Affiliates or the logistic service provider engaged by the Company or the Company's Affiliates will deliver the order to you.  To ensure the smooth, safe and accurate delivery of your purchased products and/or services, we will disclose the relevant delivery information (such as the recipient name, delivery address and contact information) to the aforementioned parties. Such parties will share the relevant delivery information to the relevant logistics and delivery service provider as designated by the product and/or service provider. You acknowledge and agree that the relevant logistics and delivery service provider will inevitably learn about and use your delivery information for delivery purpose.

 

In order for us to learn about and confirm the progress and status of delivery and to provide you with after-sales service and to resolve any disputes that may arise in a timely manner, you agree that we may collect information related to the delivery progress from the relevant logistics and delivery service provider.

 

2.1.7 Dispute resolution

 

When you contact us or request for pre-sale and after-sale support or assistance with dispute resolution, you have to provide the necessary Personal Information for us to verify your identity in order to protect the security of your account and our system.

 

For the purposes of contacting you and assisting with any issues that you may have, we may retain your correspondences/calls with us and relevant information (including account information, order information, other information provided by you to prove the relevant facts, or contact information provided by you). We will also keep a record of the issues that you have encountered and how these issues were eventually resolved. If your inquiries, complaints or suggestions are regarding a specific order, we will use your account information and order information when addressing your inquiries, complaints or suggestions.  

 

2.1.8 To use information posting functions to provide comments

 

You may post information publicly through the comment function and other information posting functions provided by us to you. Please note that the information you publicly post may include Personal Information of you or others, such as pictures containing Personal Information you choose to upload in your reviews. Hence, please consider carefully when sharing relevant information when using ByteMall and Services. If there is any child's Personal Information in your publicly-posted information, you should ensure that you have obtained the consent from the child's parent or legal guardian before posting the child's Personal Information on ByteMall or Services, and you are solely responsible for all liabilities arising therefrom.

 

2.1.9 To ensure transaction security

 

To improve account and system security and safety when using ByteMall, and to prevent phishing and fraudulent incidents, we may process your information (such as browsing information, order information, frequently-used software information and device information) to assess the security risks of your account, and we may keep records of certain links that we consider risky. We will also collect your device information to analyse system errors and traffic statistics, identify potential risks, and to detect when there are erroneous or abnormal messages sent to us from your account on ByteMall and Services.

 

2.2 Personal Information voluntarily provided by you to us

 

To facilitate your shopping process and improve your shopping experience, we may collect and use your Personal Information in the following extension functions. If you do not provide Personal Information as set out below, you can still shop online, but you may not be able to use the relevant extension functions that you are available. These extension functions include:

 

2.2.1 Extension functions based on image uploading: You can upload your photos through ByteMall to use the inquiry, after-sales service and review functions, and we will use images or videos uploaded by you to identify the product you would like to purchase. We may also use the content of your inquiry, after-sales service required and your review containing images and videos uploaded by you.

 

The above extension functions may require you to grant us the permission to access your albums (photo galleries) on your device to allow us to collect and use the information required to provide such functions. You can check the settings of each of the access permissions mentioned above and can decide to grant or deny such access at any time. Please note that by granting such access, you grant us the permission to collect and use your Personal Information to provide the functions described above. By denying the access, you withdraw the permission and we will no longer collect and use such Personal Information of you and will not be able to provide you with the abovementioned functions of which the relevant permission has been withdrawn. Your decision to deny the access will not affect the processing of previous Personal Information collected based on your consent.

 

2.3 Change of purpose of collecting and using Personal Information

 

Please be informed that as our business develops, we may adjust and change the functions of ByteMall and Services. Where the new functions or services are related to the functions or services that are currently provided by us, the collection and use of the Personal Information would be directly or reasonably related to the original purposes that you have been notified of. In the scenario that the collection and use of Personal Information are not directly or reasonably related to the original processing purposes and do not fall within the purposes of which we have notified you of, we will notify you separately of the scope and purposes of our collection and use of your Personal Information and will obtain your consent accordingly.

 

2.4 Exceptions to consent-based collection and use of your Personal Information

 

Please understand that in the following cases, we do not need to obtain your consent to collect and use your Personal Information in accordance with applicable laws and regulations and relevant national standards:

 

1. When it is permitted or related to compliance with our obligations as required under applicable laws and regulations;

2. When it is directly related to national security and national defense security;

3. When it is directly related to public safety, public health and vital public interests;

4. When it is directly related to criminal investigation, prosecution, trial and execution of sentences;

5. When it is to be used to protect the lives, property and other important legitimate rights and interests of Personal Information subjects or other individuals, and it is difficult to obtain the permission and consent of such individuals;

6. When the relevant Personal Information is voluntarily disclosed to the public by yourself;

7. When it is necessary for entering into or performing contracts per your requests;

8. When your Personal Information is collected from legally and publicly disclosed information, such as legitimate news reports, open government information and other channels;

9. Where it is necessary in our legitimate interests of operating, protecting and improving our business and services;

10. When it is necessary for maintaining the safe and stable operation of this platform and related services, such as detecting and handling errors of this platform and related services; and

11. Other circumstances stipulated by laws and regulations.

 

3. How we share, transfer, and publicly disclose your Personal Information

 

3.1 Sharing

 

We will not share or transfer your Personal Information to third parties unless you have provided your prior permission and consent, or unless the Personal Information shared or transferred has been De-identified and the third party with whom we are sharing the information cannot re-identify the Personal Information subject of such information.

 

When sharing your Personal Information, we will comply with the following principles:

 

Principle of consent: We will not share your Personal Information without your consent, unless the Personal Information shared or transferred has been De-identified and the third party recipient cannot re-identify the Personal Information subject of such information. If the third party uses the information for purposes beyond the scope of the original permission and consent, such third party will need to obtain your consent separately and it is their sole responsibility to do so.

 

Principle of lawfulness & legitimacy and data minimization: The data to be shared must be for legitimate purpose, and the data shared must be limited to what is necessary to achieve the purpose.

 

Principle of security and prudence: We will prudently evaluate the purpose of which the third parties will use the shared information, conduct a comprehensive assessment of the safety and security capabilities of these partners, and require them to comply with the legal agreement of cooperation. We will strictly monitor the security of software development kits (SDK) and application programming interface (API) through which our partners obtain information so as to protect data security.

 

We will share your Personal Information with the following business partners in accordance with the above principles and Section 2.1 of this Privacy Policy in order to provide the corresponding functions of ByteMall and Services:

 

1. Third party merchants

We must share your order information and necessary information related to the transaction with third party merchants to satisfy your request to purchase products from such third party merchants and to enable them to provide after-sales service subsequently.

 

2.Product supplier or technical service provider

We may share your Personal Information with third party service providers who provide support to our functions. Such support includes the supply of products,  provision of infrastructure and technical services, logistics and delivery services, payment services and data processing services. We share such information to enable ByteMall's shopping function. For example, we need to share your order information with our logistics service providers to deliver your ordered item; or we need to share your order number and transaction amount information with the third party payment institutions so that they can confirm your payment instructions and complete the payment process; to process your order quickly, we may engage e-commerce technical operators to assist us in processing your order, and we will disclose order-related information including the recipient's name, contact information and address to such e-commerce technical operators.

We will only share information that is necessary to achieve the purposes described above with our partners, and you understand and give us permission to share such information. If any of the abovementioned partners intend to use your Personal Information beyond the aforementioned purposes in order to provide the service function, the partner will need to seek your consent separately at its own discretion. It is also the partner's sole responsibility to do so before using or processing your Personal Information for purposes other than those notified above.

Before engaging a partner for cooperation, the Company will make commercially reasonable efforts to examine the security capabilities of the partner, assess the lawfulness, legitimacy and necessity of sharing relevant information with the partner, enter into a non-disclosure agreement with the partner, use technical measures to monitor the use of Personal Information by the partner, and make commercially reasonable efforts to urge the partner to comply with applicable laws and regulations and implement the confidentiality and security measures stipulated in the agreement when using Personal Information.

You understand and agree that if there are any changes of ByteMall and Services, we may need to adjust or add our partners accordingly to provide you with better functions and services. If we may share your Personal Information with any of the newly-added partners or other third parties, we will notify you in advance [and obtain your express consent].

 

3.2 Transfer

 

We will not transfer your Personal Information, locally or overseas, to any other third party, except for the following circumstances:

 

1. Where we have obtained your prior express consent or permission;

 

2. Where the Personal Information is transferred for mergers, acquisitions, or asset transfers: as our business develops, we may carry out mergers, acquisitions and asset transfers, and your Personal Information may be transferred as a result of such mergers, acquisitions and asset transfers. In the event of the aforementioned changes, we will continue to protect, or require the successors who receive the Personal Information to continue to protect, your Personal Information in accordance with applicable laws and regulations and the same or higher security standards required by this Privacy Policy; otherwise, we will require the successors to obtain your consent separately.

 

3.3 Public Disclosure

 

We will not publicly disclose your information unless we have obtained your consent. However, where it is required to disclose your Personal Information in accordance with applicable laws, rules, regulations, other regulatory instruments, mandatory administrative law enforcement or judicial requirements, we may disclose your Personal Information to administrative law enforcement or judicial authorities as per the required types of Personal Information and disclosure method. When we receive a disclosure request, subject to the applicable laws and regulations, we require that such disclosure request must be accompanied by the relevant legal supporting documentation, and we will only provide data that the law enforcement or judicial authorities have lawful authority to obtain for a specific investigation purpose. The documents we disclose are all protected by encryption measures to the extent permitted by applicable laws and regulations.

 

3.4 Exceptions to sharing, transfer, and public disclosure

 

Please understand that in the following circumstances, according to applicable laws, regulations and national standards, we do not need to obtain your permission or consent for sharing, transfer, and public disclosure of your Personal Information:

 

1. When it is related to compliance with our obligations as required under applicable laws and regulations;

2. When it is directly related to national security and national defense security;

3. When it is directly related to public safety, public health and vital public interests;

4. When it is directly related to criminal investigation, prosecution, trial and execution of sentences;

4. Storage of Personal Information

 

4.1 Scope and purpose of storage

 

We may store Personal Information for the purposes of providing and maintaining normal system functions and services, ensuring security, optimizing system and user experience, or as required by applicable laws.

 

4.2 Storage method

 

We will encrypt or take other security measures to ensure the security of the storage of Personal Information as required by applicable laws and regulations.

 

4.3 Storage period and disposal after expiration

 

We will only retain your Personal Information for as long as there is a legal or business purpose to do so, e.g. for the period necessary for the purpose of providing ByteMall and Services, but you understand and acknowledge that the necessary storage period may vary based on the requirement of different services and functions. The criteria we use to determine the storage period include: the time period required to retain Personal Information to achieve such business purposes including the provision of services, maintaining the corresponding transaction and business records in accordance with applicable laws, ensuring the security of the system and services, responding to potential user inquiries or complaints and troubleshooting; whether the user agrees to a longer retention period; whether there are special requirements to retain Personal Information under applicable laws or agreement. Upon expiry of necessary period, we will delete or Anonymize your Personal Information, except as otherwise provided by applicable laws and regulations.

 

5. How we protect your Personal Information

 

5.1 We attach great importance to the security of your Personal Information. We have established data security system regulations and implemented relevant and reasonable security measures to prevent unauthorized access to and modification of your Personal Information and to avoid damage to or loss of data. Our network services adopt encryption technologies such as transport layer security protocols to ensure the security of your data during network transmission.

 

5.2 We adopt data processing access control measures to avoid unlawful use of data. We will implement these technical measures and organizational management methods and will amend and refine them from time to time to improve overall security of the system.

 

5.3 In particular, we would like to remind you that ByteMall and Services may include or may link to information or other services (including websites) provided by third parties, and that these third party services may be operated by the relevant third party. Your use of such third party services (including any Personal Information you provide to such third parties) is subject to the terms of service, privacy policies (not this Privacy Policy) and other rules (if any) of such third parties, and you should read their terms carefully and make decisions after careful consideration. Please carefully protect your Personal Information and provide it to others only when necessary. You understand and agree that the Personal Information protection measures provided in this Privacy Policy only apply to ByteMall and Services. Once you leave ByteMall and Services to visit or use other websites, products, services and content resources, we no longer have the capacity or obligation to protect any information you submit on other software or websites other than ByteMall and Services, regardless of whether you log in, visit, or use such software or websites via the link or guidance of this system.

 

6. How to manage your Personal Information

 

6.1 How to access and correct your Personal Information

You can access and edit most of your profile information on ByteMall system. You may also be afforded certain rights under applicable laws, which may include the right to access, update, or rectify your data, to be informed of the processing of your data, to file complaints with authorities, and potentially other rights. If you want to know about what rights you may have or want to exercise them, or have any requests, inquiries, or complaints, please contact us at ByteMallService@bytedance.com.  

 

6.2 How to delete your account

 

After you terminate your use of ByteMall and Services, you can submit an account deletion request to us through ByteMallService@bytedance.com. Before you delete your account, we will verify your identity, security status and device information, etc. You know and understand that the deletion of an account is irreversible, and when your account is deleted, we will stop providing any services to you and delete all information about your account or Anonymize the relevant information. When the information should be retained as required by applicable laws and regulations, we promise that we will not use such information in our daily business activities.

 

6.3 Access to this Privacy Policy

 

You can view all content of this Privacy Policy on the home page of the official website of ByteMall.

 

6.4 Notifying you of the termination of operation

 

If we terminate the operation of ByteMall and Services, we will cease collecting your Personal Information in a timely manner, and notice of such termination will be sent one by one or in a commercially feasible way such as announcement.

 

7. Complaints

 

If you want to report or complain about the way we process your Personal Information, please contact us through  ByteMallService@bytedance.comof ByteMall immediately.

 

8. Changes to this Privacy Policy and notifications

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will notify you by updating the “Last Updated” date at the top of this policy and posting the new Privacy Policy and providing any other notice required by applicable law. Your continued access to or use of ByteMall and Services after the date of the updated policy constitutes your acceptance of the updated policy. If you do not agree to the updated policy, you must stop accessing or using the platform.

 

9. Others

 

9.1 This Privacy Policy applies to all functions and services that we make available to you through ByteMall.

 

9.2 The headings of this Privacy Policy are for convenience and reference only and shall not in any way affect the meaning or interpretation of any content of this Privacy Policy.

9.4 The following terms are defined in this Privacy Policy:

 

9.4.1 "Personal Information" refers to all kinds of information recorded by electronic or other means that, by itself or in combination with other information, can be used to identify a specific natural person or provide information about the activities of a specific natural person.

 

9.4.2 "Affiliates" refers to entities that we control, control us, and entities that are under common control of the same entity with us. For the purpose of this definition, "control" means the power of one entity to direct the principal business practices or activities of another entity, which may be based on equity, voting rights and other relationships that are generally considered to be dominant or having significant influence.

 

9.4.3 "De-identification" refers to the process that makes the Personal Information subject unidentifiable without the help of additional information through technical processing of Personal Information.

 

9.4.4 "Anonymization" refers to the process that makes the Personal Information subject unidentifiable through technical processing of Personal Information, and the information cannot be recovered after being processed.

 

10.Supplemental terms for Malaysia

 

10.1 In relation toSection 2.4 above, the following circumstances shall apply for Malaysia instead:

1.Where itis necessary for the performance of a contract to which you are a party;

2. Where itis necessary for the taking of steps at your request with a view to entering into a contract;

3. Where itis necessary for compliance with any legal obligation to which we are the subject, other than an obligation imposed by a contract;

4. Where itis necessary in order to protect your vital interests (i.e., matters relating to your life, death or security);

5. Where itis necessary for the administration of justice;

6. Where itis necessary for the exercise of any functions conferred on any person by or under any law.

7.Where itis for the prevention or detection of crime or for the purpose of investigations;

8.Where itis for the apprehension or prosecution of offenders;

9.Where itis for the assessment or collection of any tax or duty or any other imposition of a similar nature;

10.Whereit is for preparing statistics or carrying out research, provided that such Personal Information is not processed for any other purpose and that the resulting statistics or the results of the research are not made available in a form which identifies you;

11.Whereit is necessary for the purpose of or in connection with any order or judgement of a court;

12.Where itis for the purpose of discharging regulatory functions, where the proper discharge of which would likely be prejudiced; and

13.Where itis only for journalistic, literary or artistic purposes, provided that- (a) the processing is undertaken with a view to the publication by any person of the journalistic, literary or artistic material; (b) we reasonably believe that, taking into account the special importance of public interest in freedom of expression, the publication would be in the public interest; and (c) we reasonably believe that in all the circumstances, obtaining consent is incompatible with the journalistic, literary or artistic purposes.

 

10.2 In relation to Section 3.4 above, the following circumstancesshall apply for Malaysia instead:

 

  1. Where itis necessary for the purpose of preventing or detecting a crime or for the purpose of investigations;

 

  1. Where it wasrequired or authorized by or under any law or by the order of a court;

 

  1. Where we acted in the reasonable belief that we had in law the right to disclose the Personal Information to the other person;

 

  1. Where we acted in the reasonable belief that we would have had your consent if you had known of the disclosing of the Personal Information and the circumstances of such disclosure;
